These Terms and Conditions (“Terms”) govern your access to and use of Altivago Travel’s website, services, and bookings. By accessing or using our website or booking services, you agree to comply with these Terms and our Privacy Policy. If you do not agree, please do not use our services.

1. Definitions

In these Terms:

  • “Altivago”, “we”, “us”, “our” refers to Altivago Travel and its affiliates.

  • “User”, “you”, “your” refers to any individual or organization using our website or booking our services.

  • “Services” refers to all travel services offered by Altivago, including safari tours, accommodations, transportation, guided experiences, and related travel planning.

  • “Booking” means a reservation confirmed in writing by Altivago.

  • “Force Majeure Event” means an event beyond reasonable control, such as natural disasters, war, riots, epidemics, acts of government, or similar.

2. Eligibility

You must be at least 18 years old or satisfy the legal age requirement in your jurisdiction to make a binding booking. By booking, you represent that you meet this requirement.

3. Acceptance of Terms

Using our website, making a booking, or purchasing Services confirms your acceptance of these Terms, our Privacy Policy, and any service‑specific terms we provide. Any additional terms specific to your booking will also apply.

4. Services

We provide travel‑related services, such as safari tours, accommodation, transportation, itinerary design, and other travel planning. Some services are supplied by third‑party providers; Altivago is not liable for actions or omissions of such providers beyond legal obligations.

5. Booking Process, Payments & Confirmation

  • All bookings require written confirmation from Altivago.

  • A deposit or full payment is required by the date specified in your booking confirmation.

  • We accept payments via [list modes: bank transfer, credit/ debit card, etc.], in [currency]. All amounts stated are exclusive of applicable taxes, fees, or surcharges, unless stated.

  • If payment is not received by the due date, Altivago may cancel the booking.

6. Currency, Taxes & Fees

  • Prices quoted may not include local taxes (e.g. VAT) or fees in your departure or destination country unless stated.

  • You are responsible for applicable taxes, duties, and fees.

  • Exchange rates used by payment processors may differ; Altivago is not liable for exchange rate fluctuations or bank charges.

7. Cancellations, Changes & Refunds

  • Cancellation or change requests must be in writing to info@altivago.com.

  • The cancellation fee depends on how far in advance the request is made; the specific fee will be set out in your booking confirmation.

  • For Force Majeure Events, you must notify Altivago within [X] days of the event for relief (e.g., credit, partial refund) per the terms specified.

  • Refunds (if any) will be processed within 30 days of confirming eligibility.

  • No refunds for no‑shows once the trip/Service starts or for unused portions, unless otherwise stated in the booking.

8. User Responsibilities & Conduct

  • You must provide accurate, full, and current information (passport, visa, health info etc.).

  • Ensure you meet all travel requirements (visas, vaccinations, permits).

  • Comply with local laws, customs, and Altivago’s safety instructions.

  • You are responsible for obtaining travel insurance covering medical, trip interruption, personal injury, and lost baggage.

9. Limitation of Liability & Indemnity

  • Altivago is an intermediary; we are not liable for acts or omissions of third parties beyond what law requires.

  • To the maximum extent permitted by law, we exclude liability for indirect, consequential, incidental or special losses (including loss of enjoyment or profits).

  • Our aggregate liability in any claim shall not exceed the total amount paid by you for the booking.

  • You agree to indemnify and hold Altivago harmless from any claims arising from your breach of these Terms or misconduct on your part.

10. Intellectual Property

  • All materials on the website (text, graphics, logos, etc.) are owned by Altivago or its licensors.

  • You may use material for personal, non‑commercial purposes only. Permission required for other uses.

  • By submitting reviews or other content, you grant Altivago a non‑exclusive, royalty‑free license for their use in marketing or promotional materials.

11. Privacy & Data Protection

We process your personal data in accordance with our Privacy Policy (linked here). That policy explains what data we collect, how we use it, retention periods, your rights, and how to contact us with concerns.

12. Notice

  • Notices under these Terms (e.g., cancellation, claims) must be in writing and delivered to Altivago’s email or physical address.

  • Notices are effective upon delivery if by email, or upon [X] days after posting if delivered by mail.

13. Dispute Resolution

  • Please contact us at info@altivago.com if you have a complaint; we aim to resolve issues informally first.

  • If not resolved, disputes may be resolved through mediation or arbitration if mutually agreed, before resorting to courts.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Kenya. Any dispute arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya, unless local mandatory law requires otherwise.

15. Assignment

You may not assign your rights or obligations under these Terms without our written consent. Altivago may assign or subcontract any of its obligations without restriction.

16. Severability & Entire Agreement

If any clause is found invalid or unenforceable, the remaining clauses shall continue in full force. These Terms, plus your booking confirmation and the Privacy Policy, constitute the full agreement between you and Altivago.

17. Amendments to Terms

  • We may revise these Terms from time to time. We will post updates on our website with the updated “Last updated” date.

  • If changes are material (affecting price, cancellations, liability), we will notify affected users via email. Your continued use after changes implies acceptance.
